TERMS AND CONDITIONS

1. GENERAL INFORMATION

a. These terms and conditions are relevant to every order that is placed and every agreement that is reached through bublegumsr.com.

b. By placing an order on bublegumsr.com, you agree with the terms and conditions of bublegumsr.com.

c. Unless explicitly agreed upon by all parties involved and confirmed in writing by bublegumsr.com, deviations from these terms and conditions are not applicable to any orders or agreements reached through bublegumsr.com.

2. ORDERS AND CONTRACTS OF SALE

a. The products shown on bublegumsr.com are part of a non-binding online catalogue; they are not a legally binding product offering.

b. When you place an order on bublegumsr.com, you will be asked to confirm your order when you reach the final step of the ordering process. After confirming your order, you have placed a binding order for the chosen products.

c. After placing your order, bublegumsr.com will send you a confirmation email to confirm that your order has been successfully received. The email will be sent to the email address provided during the ordering process.

d. The order confirmation does not yet constitute a contract of sale. It is only intended to inform you of the fact that bublegumsr.com has received your order.

e. A binding contract of sale comes into place after payment is received and bublegumsr.com confirms shipment of the product.

f. If payment is not successful, the order will automatically be cancelled and a contract of sale will not come into place.

3. INTERNATIONAL ORDERS

a. We accept orders from any country in the world and we ship worldwide.

b. International orders outside the European Union (EU) may be subject to custom charges and import taxes. If you live in a country outside the EU and customs charges or import taxes are imposed on your order, you will have to pay for these charges upon delivery of your order. As we have no control over customs charges or import taxes, please understand that bublegumsr.com cannot be held responsible for any additional customs charges or import taxes imposed on your order.

4. INVENTORY

a. If a product is out of stock, bublegumsr.com will automatically inform you hereof.

b. In the event you place an order for a product that is out of stock and you were not informed hereof in time (e.g. due to technical defaults), bublegumsr.com has the right to cancel your order. If you have already paid for the product, bublegumsr.com will reimburse you for the exact amount you paid.

5. PRICES

a. You will be charged the prices as shown on bublegumsr.com at the time you place your order.

b. Prices shown exclude shipping costs.

c. The exact shipping costs are automatically calculated when you place your order and will depend on your shipping address, the weight, and the size of your order.

d. bublegumsr.com has the right to cancel promised products in the event that prices were incorrectly displayed due to technical errors.

6. PAYMENT OPTIONS

a. You can pay for your order using available payment methods, including PayPal, Visa, Mastercard, Maestro, American Express, Apple Pay, Google Pay, and other regional payment portals supported at checkout.

b. All payments through bublegumsr.com are processed via secure payment portals

c. When you have finished shopping and choose to proceed to checkout, you will be asked to complete your payment. Once you select your preferred payment method, you will be redirected to the secure payment portal, and after completing payment, you will be redirected back to bublegumsr.com.

7. SHIPPING

a. Your order will be shipped after your payment is received.

b. When payment for your order is received, we will process and ship your order within 1 to 5 business days. Products will be shipped to the address provided when you placed your order.

c. As soon as your order is shipped, you will receive a confirmation email including tracking details.

d. Shipping within Europe generally takes 2 to 7 business days from the day of shipment, depending on your location. Shipping outside of Europe generally takes 3 to 15 business days from the day of shipment.

e. These delivery times are an indication, not a guarantee. Longer delivery times than indicated will not entitle you to compensation, to cancel your order, or to revoke your contract of sale.

f. Shipping costs are automatically calculated when you place your order and depend on your shipping address, weight, and size of your order.

g. Customs officials are authorized to open packages for inspection. As this is out of our control, please understand that we cannot accept responsibility for any orders delayed by foreign customs.

h. We ship our products with reputable courier services (e.g., Correos, DHL, UPS, FedEx). If you fail to collect your package at the designated pickup address and the package is returned to us, we will reship the package to you provided that you pay for the additional shipping costs.

i. For all packages, it is required that you sign for delivery. Therefore, it is important that someone is present at the address at the time of delivery.

j. You should never accept a package that shows signs of external damage. If you accept a package that appears undamaged on the outside but the product inside is damaged, send an email to info@bublegumsr.com with images of the damaged product and original packaging within 1 business day of accepting the package.

k. If you entered an incorrect address during your order process and we are forced to reship your package, an additional shipping charge equal to your original shipping cost will apply.

8. RETURNS

Returns are accepted within 14 calendar days of delivery, provided the item is unused, undamaged, and in its original condition. However, returns will not be accepted if the item has been used or damaged, if the 14-day window has passed, or if the return is sent without prior written authorization via info@bublegumsr.com; additionally, in accordance with EU consumer regulations, custom-commissioned artworks and personalized items are strictly non-refundable.

9. WARRANTY & COMPLAINTS

a. Please examine your order upon delivery. In the event that your order is incomplete or damaged, send an email to info@bublegumsr.com with photos of the damaged product and original packaging within 1 business day of receipt.

b. In case of a damaged or incorrect product, you are entitled to a replacement product free of charge. If the product is no longer available, you may choose an equivalent product of equal value or request a full refund.

c. bublegumsr.com will not compensate any damage occurring to products due to improper handling or misuse.

10. LIABILITY

a. bublegumsr.com is never obliged to pay compensation for damages except if and insofar as the damage suffered was inflicted intentionally or by gross negligence. Liability for loss of profits, indirect, or consequential damages is at all times excluded.

b. In all cases where bublegumsr.com is obliged to pay compensation, this amount will never exceed the invoice value of the product concerned or the amount covered by insurance.

c. bublegumsr.com contains links to third-party websites and services that are not operated by us; we cannot be held responsible for the content, privacy policies, or quality of these external services.

11. FORCE MAJEURE

a. bublegumsr.com is entitled to invoke force majeure if the execution of the contract is prevented or impeded by circumstances beyond our reasonable control (including natural disasters, strikes, transport blockades, supply delays, or system outages).

b. In the case of force majeure, our obligations are suspended. If the situation lasts longer than three months, both parties are authorized to revoke the contract of sale in writing.

12. GOVERNING LAW & JURISDICTION

a. Agreements reached and orders placed through bublegumsr.com are governed exclusively by Spanish Law and applicable European Union regulations.

b. In the event of a dispute, consumers may also utilize the European Online Dispute Resolution (ODR) platform at www.ec.europa.eu/odr.

c. Any disputes arising between the customer and bublegumsr.com that cannot be settled amicably shall be submitted to the competent courts of Spain (specifically the region of Galicia), regardless of the customer's residence address, without prejudice to mandatory statutory consumer venue rules.

d. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

13. COPYRIGHT AND INTELLECTUAL PROPERTY

a. bublegumsr.com owns or holds the license to all photos, artwork, graphic designs, logos, and texts displayed on the website.

b. bublegumsr.com and the artist Bublegum remain the sole and exclusive owners of all copyrights, brand names, domain names, registered and unregistered designs, and other intellectual property.

c. Customers are not granted any property rights over any artworks, prints, or products purchased. Reproduction, distribution, or commercial exploitation without prior written consent is strictly prohibited.

d. All preliminary materials, visual sketches, and digital files used to create a product or project remain the sole property of Bublegum.

14. DISCLAIMER

We devote constant care to the composition and accuracy of the content on bublegumsr.com. However, information provided may occasionally be incomplete or contain technical errors.
